An industrial accident is any form of workplace accident. Causes of industrial injuries include: industrial accidents, assaults at work, exposure to excessive levels of noise or vibration and exposure to chemicals, dust and asbestos.

This can be achieved by carrying out risk assessments for individual tasks, providing training, using equipment that is well maintained and suitable for the job and keeping the workplace clean, tidy and free from hazards.

Employees: As an employee it is also important that you keep in mind your own safety and the safety of others whilst working. Many industrial injuries can be avoided if employees ensure that they act in a responsible manner, use any personal protective equipment provided and follow the procedures and safety guidelines set out by their employer.

Making an Industrial Accident Claim

It is always a good idea to obtain prompt legal advice if you have suffered an industrial accident and believe that you may be entitled to make a compensation claim. In every case, medical evidence will be required. Detailed expert evidence is often also required in industrial disease cases to show that the condition suffered by a claimant was caused by exposure to a particular substance.

In any industrial injury claim it is necessary to show that the person you are making a claim against owed you a duty of care, that they breached that duty of care (were negligent), and that the injury you sustained was a reasonably foreseeable consequence of that negligence. If an industrial accident does occur, you should try to record as much information as you can, taking photographs where possible. Industrial Injury Compensation

There are two elements to a compensation award. The first, called general damages, is for the pain and suffering you may have gone through and any loss of amenity (e.g. an inability to look after your garden, do DIY or play sports). The award for loss of amenity can be for a short period after an industrial accident or for ever if that is what the medical evidence supports.

The second element, in respect of your losses and expenses, is known as special damages and aims to put you back in a position financially as if your industrial injury had never occurred. It is important to keep receipts for any expenditure you have related to the accident so that these can be reclaimed.

In serious cases, where a person may no longer be able to continue their employment, this can be taken into account. Costs for care, equipment, transport and housing modifications can also be factored into the calculations. A court can also make a financial award to recognise that an injured worker's prospects on the open labour market may be limited.

If a person is fatally injured, a dependent relative such as a widow and children may be able to claim a statutory sum for their bereavement and funeral expenses, but also sums for the loss of income, pension, services such as DIY, house decoration and gardening and contribution to the household in the form of future losses.

A person who has suffered an industrial injury or disease through work may be entitled to apply for a government benefit known as IIDB, or Industrial Injuries Disablement Benefit.

The amount payable will depend upon the level of disability caused by the injury or illness.
