Breast Reduction

Although not as common as breast enlargement, breast reduction operations are carried out on a frequent basis, often for women who suffer neck and back pain or those that are self conscious about their appearance. Sometimes a reduction can be carried out on one breast if it is much larger than the other to even the size.

The procedure is carried out by removing skin and fat from the breasts, then reshaping them to a smaller size. The intended result is agreed between the patient and surgeon beforehand and they should advise of any potential scarring, side effects and complications.

Most breast reduction operations are carried out carefully and successfully with good results.

Medical Negligence / Surgical Errors

All operations carry with them a certain risk of complications, some of which are unavoidable. Some patients however, will go through unnecessary pain and suffering because of clinical negligence. In these cases it should be possible to make a personal injury claim for damages.

Unanticipated levels of scarring or uneven and lumpy results can be extremely upsetting for a patient and may leave them with shattered self confidence. There can also be bleeding or bruising following a breast reduction procedure which, if left untreated, can lead to infection. As well as surgical errors, negligent after-care can also cause injury and distress.

Breast Reduction Negligence Claims

Anyone who has endured pain and suffering as the result of a surgical error or negligent post-operative care, may be entitled to claim compensation. An expert clinical negligence lawyer, such as those employed by The Legal Line, will be able to assess the merits of each individual case and advise accordingly.

The assistance of a specialist lawyer can be invaluable, as making a clinical negligence claim is often complicated. They can collate all of the relevant evidence and the best course of action.

In every case, medical evidence will be required. It is necessary to show that the person you are making a claim against owed you a duty of care, that they breached that duty of care (what is known in law as negligence), and that the resulting problem was a reasonably foreseeable consequence of that negligence.

For clinical negligence claims, this means that it has to be proven that no reasonable medical professional would have provided treatment in the same way and that the treatment received fell below the accepted standards of care. Before and after photographs will also be helpful to your solicitor in assessing compensation.

Compensation

There are two elements to a compensation award.

The first, called general damages, is for the pain and suffering you may have gone through and any loss of amenity (perhaps an inability to, drive, exercise or clean the house). The award for loss of amenity can be for the recovery period after further surgery or for ever if that is what the medical evidence supports.

Whereas the first element of compensation cannot make you better and can only really apologise, the second element of a compensation award, for your losses and expenses,
is known as special damages and aims to put you back in a position financially as if the problems you have encountered had never occurred. This would include any loss of earnings related to your injury and, in serious cases where a person is no longer able to continue working, an amount of damages to reflect this.
