Back Injury at Work Caused by Faulty Tail Lift

A driver was injured in an accident at work because he was provided with a faulty vehicle by his employer. Our expert personal injury solicitors made a successful compensation claim against his employer on his behalf.

Accident at Work

Our client was making a delivery to a clothing store at the time of his workplace accident. He opened his vehicle, then checked that the tail lift was operating correctly by raising and lowering it. Initially it moved at an unusual angle, so he tried it again. When it appeared to be working normally he stepped on to begin using it and raised it to the unloading position in order to remove items from the trailer.

Suddenly however, the tail lift completely sheared away from the trailer and crashed to the ground, causing the claimant to fall. He sustained injuries to his neck, back and shoulders as a result. He had to take time off from work to recover and required physiotherapy treatment.

Claim Against Negligent Employer

The injured driver felt that his employer was responsible for the accident, as they provided him with faulty equipment. He instructed our lawyers, who specialise in back injury and accident at work cases, to assist him in making a personal injury claim.

Previous complaints had been made about the vehicle tail lifts not operating correctly and a similar incident involving another member of staff also occurred prior to our client’s accident. Despite this, and regular servicing of the vehicles, the fault had not been picked up and repaired.

Liability was admitted by the defendants and our lawyers were able to negotiate a settlement of £13,000 in damages on the claimant’s behalf. This took into account both the pain and suffering caused by his injury and also his financial losses, including his loss of earnings, travel costs related to the injury and payment for work done on his home by tradesmen that he planned to do himself but could not.
