Manual Handling Accident

Whilst stowing a triple-extension ladder away onto a gantry, our client suffered a back injury.

He had been required to move the large ladder by himself, when two people sharing the lift would have been a safer way to carry out the manual handling.

Employer Liability Claim

The claimant felt that his employer was responsible for the personal injury he suffered, and decided to pursue a claim, appointing our specialist lawyers to handle the matter on his behalf.

The defendants were unable to prove that our client lifting the ladder alone could not have been avoided and their evidence did not show that they had carried out assessments on the manual handling task or taken all reasonable measures to prevent the risk of injury.

When the case was heard in court, we argued the Defendant could not legally defend the claim and they gave in before trial. The trial proceeded and he was awarded damages.
