Employee Receives Compensation for Serious Eye Injury at Work

In a recent personal injury claim, our specialist solicitors secured compensation for a man who suffered a serious eye injury in an accident at work.

Injured by Flying Debris

Our client was unloading some items from a trolley, while some concrete work was being carried out by a colleague several metres away. Our client was not wearing goggles, as the instructions he was provided with about personal protective equipment were not clear and he had only been told to wear them when he was very close to hazardous work.

He felt sudden pain in his eye and it started to bleed. He was helped to his supervisor’s office and was then taken to hospital, where it was found a piece of metal was embedded in his eye. There was significant damage and he had to have 2 operations. Unfortunately, the sight in his eye could not be saved and his vision was permanently affected, so he was no longer able to continue in the same job.

When he returned to work, our client had to be re-deployed to a lower paid job with less favourable working hours.

We were appointed by the injured employee to pursue a compensation claim on his behalf. He felt that his workplace accident could have been avoided if better health and safety procedures were in place.

His employer admitted that they were responsible and we put forward detailed medical evidence and information about our client’s financial losses so that an appropriate amount of compensation could be provided. Their first offer was too low, so we rejected it and successfully negotiated for an increase. Our client received damages in excess of £130,000 in respect of his injury, loss of earnings, injury-related expenses and the effects on his future earnings and career prospects.
