Cycling Accident Victim Compensated for Serious Shoulder Injury

26th January 2012

Cyclists involved in road accidents are more vulnerable to personal injury than drivers, as they are not afforded the protection that a vehicle provides. Our specialist personal injury lawyers recently acted in a compensation claim for a cyclist, who suffered a serious shoulder injury when he was hit by a car.

Driver Pulled Out From Side Road

Our client was cycling home from work when his accident happened. It was a dark, damp morning, however he was wearing bright clothing and had several lights and reflectors on his bicycle and person, so he should have been easily visible to other road users.

As he approached the entrance to a car park he could see that a car had come to a stop at its junction with the road. When he was just about to pass it however, the driver suddenly pulled out into his path. Our client was thrown over the bonnet of the car and landed on the ground.

His shoulder was dislocated as a result of this cycling accident and he was treated at hospital. Despite having a course of physiotherapy he continued to have a lot of trouble with his shoulder and it was discovered that the cartilage was torn, so he had to have a steroid injection and eventually an operation.

Our client relied heavily on his wife during his recovery and he had to take a lot of time off work. His enjoyment of cycling was also badly affected and he could not continue to use his bicycle to commute to work.

Personal Injury Claim

The injured cyclist felt that the driver of the car was responsible for his accident, as he pulled out onto the road when it was not safe to do so and he should have given way.

He instructed our expert lawyers, who have decades of experience in handling road traffic accident claims, to assist him in recovering compensation. We made a claim against the driver’s insurance company and they admitted liability, so we obtained evidence of our client’s injury and his financial losses in order to negotiate for an appropriate settlement.

We secured damages in excess of £20,000 for our client after rejecting an initial, lower offer from the other side. He was compensated for the injury itself and also his loss of earnings, the damage to his bicycle and helmet, the extra travel costs he incurred and his other expenses related to the accident.
