Hotel Customer Injured in Accident Abroad Receives Compensation

We recently acted on behalf of a woman who was injured in a holiday accident. She suffered a fall at a hotel and damaged her wrist because the facilities were not in a safe condition. Her personal injury claim was successful and she received compensation.

Accident on Holiday

The claimant and her husband were on a package holiday with a major tour operator when her accident occurred. She was walking through the hotel bar, wearing sensible, flat-soled shoes, when she slipped and fell due to water on the floor. The water was present because of a leak in the roof and the hotel were clearly aware of this as there was already a bucket underneath it. Unfortunately the bucket was not sufficient to stop water from leaking onto the floor and it had been placed out of view behind a pillar, so our client could not see it until it was too late. There were no warning signs nearby to notify customers about the leak.

As she landed she injured her wrist and this personal injury ruined the remainder of her holiday. Initially it was suspected she had suffered a fracture, but x-rays confirmed the injury was actually soft tissue damage. Her symptoms continued for 2-3 months, during which time she needed help from her husband and the pain from her injury disturbed her sleep.

Claim Against Tour Operator

Our client felt that her accident could have been prevented if better health and safety measures were in place at the hotel. She asked us for help with a compensation claim against the tour operator, as they failed to ensure that safe facilities were provided.

The defendants admitted that they were primarily responsible for the accident, but tried to argue that the injured customer was partly to blame. We challenged them to provide evidence to this effect however and they could not. They did not put forward any offers of compensation, so we began court proceedings.

Before the case went to trial an offer was made which our client accepted and she received £3,000. This was in respect of her injury and also her losses, including a pair of glasses she damaged in the accident, travel costs to physiotherapy appointments and the lost enjoyment of part of her holiday.
