Back Injury Claim for Employee Injured in Manual Handling Accident

Accident at Work

Whilst working on a printing press, our client had to manually move a large drum of chemicals. It had a 25 litre capacity and was very heavy, however the handle at the top of the drum was small and only large enough for one hand. He needed to take it across the room and up a set of steps, but no lifting equipment was provided for this, no assistance was available and he had not received any manual handling training.

As he attempted to carry the drum up the steps he felt a ‘pop’ in his lower back and immediately experienced a lot of pain. He was diagnosed with a prolapsed disc and required extensive medical treatment. Our client also had to take a number of months off from work before a phased return, during which time he incurred a substantial loss of earnings. He was left with some long term problems with his back.

Injury Claim

The claimant felt that his employer was responsible for his workplace accident, as they failed to provide a safe system of work. He therefore instructed our expert personal injury lawyers to assist him with a compensation claim.

His employer initially denied liability, so it was necessary to commence court proceedings. It was possible to negotiate a settlement before the case went to trial however and our client received £30,000 in damages. This sum took into account the pain and suffering caused by his injuries and also financial losses, including his loss of earnings and the costs of medical care.
