Faulty Work Equipment Causes Personal Injury

A C.D.T. technician injured by a circular saw in an accident at work was awarded compensation, with help from our specialist lawyers.

Defective Equipment

As part of his job at a school, the claimant was using a circular saw. He suffered a deep laceration to his thumb as the machine was not sufficiently maintained.

Wear and tear on the insert upon which the blade sits made it possible for an off-cut of wood to fall down into an extraction chamber. The piece of wood was then thrown back towards him and he reacted by moving back, thus injuring his thumb on the blade.

Personal Injury Compensation

The claimant’s employer tried to argue that they had not breached PUWER (Provision and Use of Work Equipment Regulations) and did not cause the accident, however our lawyers were able to prove that there was a breach of the regulations and they were responsible.

The Judge found in favour of the claimant and an award of damages was made for his personal injury.
