Pedestrian Injured by Fall on Defective Pavement

We recently acted in a personal injury claim on behalf of a man who suffered a tripping accident on a high street because of unsafe paving. He received compensation for the injuries he suffered in the accident.

Accident on Public Property

Our client was walking along the pedestrian area of a high street, which was paved with small, granite blocks. One of these blocks was raised above those around it and it caught our client’s foot, causing him to trip and fall.

As he landed, the claimant sustained injuries to his hand, leg, wrist and fingers, including a fractured knuckle. He was treated at hospital and his injuries meant that he had to be put onto light duties at work for 2 months until he had recovered. He was left with some occasional discomfort in his hand even after the bone had healed.

Personal Injury Claim

The claimant felt that the local Council was responsible for his accident, as they failed to maintain the busy pedestrian area to a safe standard. He therefore approached our expert personal injury lawyers for assistance with a compensation claim.

We contacted the Council’s insurer with details of our client’s fall and they admitted liability. We then put forward medical evidence of his injuries and began negotiations in respect of a suitable amount of compensation. The Defendant’s initial offer was very low, so we rejected it on our client’s behalf and commenced court proceedings. They subsequently agreed to increase their offer before the case went to trial and our client received £5,000 in damages. The hazardous paving was also repaired.
