£10,000 Damages for Slipping Accident at Train Station

27th July 2007

In a recent accident case, our specialist personal injury lawyers recovered compensation for a man injured at Marylebone train station after he slipped due to a leaking roof.

Accident in Public Place

Whilst walking towards the ticket barrier in Marylebone station, Richard Wilmot slipped and fell, fracturing his shoulder, as a roof that was proven to have been leaking for more than two years caused the floor to be wet.

He was unable to work for two months and required hospital treatment and physiotherapy.

Personal Injury Claim

In failing to repair the leaking roof, Mr Wilmot felt that Chiltern Railways were negligent and that this was the cause of his accident.

He appointed The Legal Line’s lawyers to assist him in making a personal injury claim against them, as the known defect they ignored posed a risk to passengers.

Initially the defendants did not admit liability, even though their own documentation showed that the leak had been present for at least two years. When our lawyers began the process to initiate court proceedings however, they agreed to settle out of court. Mr Wilmot was awarded £10,000 damages in respect of his injuries and losses.
