Clinical Negligence Claim for Man Injured by Surgical Error

28th March 2011

We recently acted in a clinical negligence claim on behalf of a man left with permanent problems due to a surgical error.

Mistake During Operation

Our client underwent a routine operation to treat a collection of fluid which had formed in his scrotum. He was expected to make a full recovery without any functional problems or lasting pain. Unfortunately however, the incision for the procedure was not made in the correct place and this led to his testicle becoming adhered to the scrotum and held in an unnaturally high position.

This mistake left our client with daily pain and discomfort, an abnormal appearance and an inability to have a full physical relationship with his partner. Further surgery to attempt to rectify the problem has only a small chance of success, but carries with it a considerable risk of further harm.

Compensation Claim Against Hospital

Our lawyers are specialists in medical negligence cases and the claimant appointed us to pursue a compensation claim on his behalf, as he felt the hospital was negligent.

We began a case against the NHS Trust involved and they denied that they were responsible for the adverse outcome of our client’s treatment. We collected expert medical evidence and pushed forward with the claim and we were able to negotiate a settlement of £25,000 in damages on his behalf.
