Successful Personal Injury Claim for Child Injured at Nursery

In a recent personal injury claim our lawyers recovered compensation on behalf of a child, who suffered a fractured arm in an accident at nursery school.

Lack of Supervision

Our client was 2 years old when her accident occurred. She suffered a fall from some outdoor play equipment at nursery whilst trying to reach a fireman’s pole and injured her arm. Despite a previous risk assessment stating an appropriately qualified member of staff should be near to the pole at all times when it was in use, the only supervision was provided by a 16 year old student on work experience.

Although our client was the only child still out in the playground, the student was distracted when she approached the pole, but she did not block the entrance to it before turning her attention away.

Compensation Claim

The nursery denied liability, as the play equipment had been approved by an Ofsted report. They blocked the gap that allowed access to the fireman’s pole after the accident however and we asserted that a prudent parent, which is the standard of care to be upheld by nurseries, would have blocked access to the pole before turning away.

The Judge accepted that the nursery breached the standard of care and the injured child was awarded compensation in respect of her injuries.
