Accident at Work Caused by Faulty Handrail

Our specialist personal injury lawyers recently assisted an employee who was injured in an accident at work, as the result of a fall on some stairs.

Unsafe Workplace

When his accident occurred, the claimant was walking up a flight of stairs. He took hold of the banister near to the top and it came away from the wall in his hand, causing him to lose his balance.

He fell down the stairs and injured his shoulder and one of his fingers. The claimant felt that his employer was responsible for his personal injury and appointed our lawyers to assist him in making a compensation claim.

Personal Injury Claim

Evidence showed that the handrail was not maintained to a good level of repair.

The Judge accepted that the claimant’s employer had breached regulations 5 and 12(5) of the Workplace Regulations 1992 in strict liability terms and found in favour of the claimant.

He was awarded compensation in respect of the injuries and losses he suffered as a result of this workplace accident.
