Knee Injury Caused by Fall From Defective Truck Step

Faulty Equipment

After loading an HGV and parking it up, our client was climbing down from the cab using the two steps provided. Unfortunately one of the steps was cracked and this caused him to slip from it. He landed awkwardly and sustained a knee injury.

Upon speaking with a colleague our client found out that the step had in fact been broken for over a year and, although this had been reported to his employer, it had never been repaired.

Our client had to take a lot of time off work because of the pain caused by his injury. Even though his employer provided basic pay during this time he still incurred a loss of earnings, as he no longer qualified for shift allowances and some other benefits. He required extensive treatment, including physiotherapy, and during his recovery he had to rely on his family members for assistance.

Although he was able to return to work and resume most normal activities, our client’s knee was permanently damaged and he is likely to suffer ongoing problems with it in the future.

Employer’s Liability

We acted on the claimant’s behalf in an injury claim against his employer, as they provided faulty work equipment and this caused his accident. The step itself was repaired very soon after the incident occurred.

They denied that they were responsible at first, however through negotiations with the Defendants we were able to secure a compensation settlement of £10,000 for our client.
