School Employee Injured in Manual Handling Accident

In the course of her work, a school employee suffered a shoulder injury whilst trying to assist a pupil using a wheelchair. Our expert personal injury lawyers assisted her in making a compensation claim against her employer, who had not employed sufficient safety procedures for manual handling.

Injured at Work

The claimant’s accident at work occurred when she was pushing a pupil to the toilet in his wheelchair. He usually attended school in an electric wheelchair but would on occasion come in a manual one.

She had to push the chair, which together with the pupil weighed around 13st, up a ramp. As she is petite, in order to do this successfully the claimant had to apply force to give an ‘extra push’, and in doing so injured her shoulder.

Personal Injury Claim

The claimant felt that her employer did not do enough to protect her from the risk of injury at work and so appointed our expert lawyers to assist her in making a personal injury claim.

The defendant tried to argue that there was no risk presented by the slope, however it was found that they had not carried out a risk assessment and also that the difficulties presented when using the manual wheelchair had already been noted prior to the incident. The Court found in favour of the claimant and she was awarded damages.
