Compensation Claim for Respiratory Condition Caused by Welding Fumes

Work-Related Illness

In his job role, our client was required to operate automatic welding machines and carry out hand welding. Through this work he was exposed to welding fumes and he developed respiratory problems as a result.

No COSHH (Control of Substances Hazardous to Health) risk assessments had been carried out before his symptoms began, there was no air monitoring within his work area, and there were inadequate ventilation / extraction systems to remove the fumes.

Because of his symptoms our client had to take time off work and he therefore lost earnings.

Industrial Disease Claim

Our client felt that his employer was responsible for his health problem, so he sought assistance from our lawyers, who are experts in all areas of personal injury and industrial disease.

We began a compensation claim on his behalf. His employer refused to accept liability however, so we had to pursue the case to Court. The Judge heard evidence from engineers and medical specialists and agreed that our client’s health had been affected by his working conditions. He was awarded damages in excess of £8,000 in respect of his illness and loss of earnings.
