Our Lawyers Secure £600,000 Compensation for Victim of Serious Workplace Accident

20th September 2010

In a recent case, our specialist personal injury lawyers assisted a man who suffered a serious injury in an accident at work.

JCB Accident

At the time of his personal injury, our client was working on a site where a JCB was in use. The driver needed to change the bucket for a different size but was having some trouble releasing it, so our client and a colleague went over from where they were working to offer their help.

The claimant asked the driver to put on the safety guard so that they could all take a proper look. Once the vehicle was secure they tried to clear the blockage and the driver then got back into the cab Unfortunately, in doing so he accidentally knocked a switch or lever, causing the arm and bucket to swing suddenly. It struck our client with considerable force and threw him backwards, causing very serious injuries to his hand and arm as he put up his hand instinctively to protect himself.

Serious Hand Injuries

As a result of this workplace accident our client’s hand was partially severed with multiple fractures and crush injuries. He required several operations to repair the damage and was left with severe scarring and permanently limited use of the affected hand and arm.

His ability to work, continue with hobbies or carry out DIY and gardening at home in his former capacity was impaired and he was self-conscious about the appearance of his injured arm.

Our lawyers assisted him in pursuing a personal injury claim against the company who supplied the JCB and driver and also the company he worked for. We were able to obtain an interim payment after liability had been agreed, to help our client financially whilst we negotiated a suitable sum of damages with the other side. It was necessary for us to reject initial, low offers, but we were eventually able to secure a total settlement of £600,000 compensation on the claimant’s behalf. This sum represented the pain and suffering caused by his injuries and also his financial losses, including his loss of earnings and future earning potential.
