Airline Employee Receives Knee Injury Compensation

29th November 2010

An airline worker suffered a knee injury in a manual handling accident at work and our lawyers recovered compensation on his behalf in a personal injury claim.

Manual Handling Injury

Our client was working alone on a nightshift when he suffered a workplace accident. He needed to move a large aircraft wheel, which weighed in excess of 200kg, to a lorry so that it could be transported. The wheel was deflated so it could not be rolled, however he was not provided with any lifting equipment for the task and there was no one around to assist him. He had also not received any specific training for moving the wheels. As he attempted to manoeuvre the wheel it began to topple over and, in attempting to support its weight, he badly injured his knee.

He had experienced some problems with his knee in the past, but was still able to work normally before this accident at work. After the accident however he was in a lot of pain and had to undergo an operation, physiotherapy and hydrotherapy to help relieve his symptoms. He was unable to attend work for a number of months and incurred a loss of earnings because of this.

Claim Against Employer

The injured employee appointed our specialist personal injury lawyers to assist him in making a compensation claim. We pursued the case on the basis that he was not provided with a safe system of work, as he did not have the relevant equipment, assistance or training to carry out the task safely. Other airlines had trolleys in place that could be used for moving the large wheels.

Our client’s employer refused to admit liability for the accident, so we began court proceedings. They then made an offer of compensation, however it was not a reasonable offer in light of the injury our client sustained and the effect it had on his life. We therefore entered into negotiations with the defendant to secure an increased offer of £10,000 on his behalf.
