Council Employee Injured due to Lack of Safety at Work

Our specialist personal injury lawyers recently assisted a council gardener who was injured when he was thrown from a ride-on mower whilst cutting grass at a cemetery.

Injured at Work

When his accident occurred, the claimant was using a ride-on mower at a cemetery. He had not been trained on the use of the mower and had not worked at a cemetery before.

The grass was badly overgrown at around 18 inches long and, as he went down what he thought was an ‘aisle’ between the graves, the front wheel of the mower went into a sunken grave that had not been ‘topped up’. He had not seen the edging stones of the grave because of the length of the grass.

The mower tipped over and the claimant was thrown from it, as a result of which he aggravated a pre-existing shoulder injury, required medical treatment and had to take time off from work.

The matter was pursued to court as the council refused to negotiate a settlement. The Judge found that the cemetery was not maintained in good working order and the grass was sufficiently long to create an unsafe place of work. Our client was therefore awarded compensation in respect of his injuries and losses.
