Injury Claim for Man Who Slipped in Flooded Toilets at Work

A community centre worker suffered a fractured elbow when he slipped and fell due to flooded toilets. Our expert personal injury lawyers assisted him in recovering compensation.

Fall at Work

Our client was working a shift at the community centre when someone noticed water on the floor of the toilets. He went to investigate and found that they were flooded, because someone had plugged the sinks and turned on the taps, causing them to overflow. As he approached the sinks to turn off the taps he slipped on the water and fell.

As a result of this accident at work, his elbow was fractured and he required hospital treatment and time off from work.

Claim Against Employer

Prior to our client’s accident, there was a similar incident in a different set of toilets. Despite this, the plugs were not removed from all sinks on the premises and the taps were not fitted with an automatic shut off facility. There were also no procedures in place for a regular system of checking the toilets, which was in breach of the Workplace Regulations.

The injured employee therefore appointed our lawyers, who have extensive experience in workplace accident cases, to assist him in making a personal injury claim. We asserted that greater health and safety measures should have been in place, especially as the centre was open to children.

The defendant refused to accept liability for the accident however, so it was necessary for us to pursue the case to Court. The Judge agreed that there should have been a system of inspecting the toilets regularly, as the centre was a public building, and that the taps should have been fitted with a flow-limiting device. Such taps were fitted after the accident occurred.

It was also found that better risk assessments and training on how to deal with flooding, rather than walking through the water, should have been provided. Our client was therefore awarded damages in respect of his personal injury.
