Employee Left With Permanent Shoulder Injury From Accident at Work

Injured at Work

The claimant was investigating the cause of a lighting failure in the course of his work as an electrician. The scissor lift that he would normally use for access was out of order, so he used a metal ladder that was available. He was working at approximately 20ft from the ground.

He began to trace along a cable with his hand when he suffered a large electric shock. This caused a burn to his hand and he also fell from the ladder, sustaining a shoulder injury. Our client underwent extensive medical treatment for the damage to his shoulder, but he was still left with ongoing pain and an inability to lift anything heavy or raise his arm above a certain height. This affects his ability to work, continue with his hobbies or carry out some household tasks, such as gardening and DIY.

Personal Injury Claim

Our client felt that his employer could have prevented his accident at work by implementing better health and safety measures, including the use of personal protective equipment and a safer system of work. He was not provided with rubber gloves, which could have avoided the electric shock, and it is unlikely he would have fallen to the ground if the scissor lift had been operational. Additionally the reason that the problem occurred with the cable in the first instance was that an inappropriate fitting had been used that was too small for the current.

We made a personal injury claim against the client’s employer on his behalf. They did not accept liability for the incident, so it was necessary to commence court proceedings. The case went to trial and the Judge found in favour of our client, who received £40,000 in damages, in respect of his injuries and related financial losses.
