Lack of Equipment Causes Serious Hand Injury

21st March 2012

A man suffered an accident at work because his employer failed to provide the equipment and protective clothing he needed to carry out his work safely. Our expert personal injury lawyers acted on his behalf in a compensation claim.

Broken Machinery

Our client was cleaning out some large steel drums at work, to prepare them for re-use. This was not something he had done before and the task was normally carried out by a machine, however the machine had not been working for some time. He was therefore doing it by hand.

As he reached into one of the drums he injured his hand on some blades that were stuck to the bottom. The injury could have been prevented or lessened if he was wearing cut-resistant gloves, but there were none provided.

There was a deep gash across the palm of our client’s hand and index finger. One of the nerves was badly damaged and he was admitted to hospital for an operation to repair the nerve and close the wound. He was unable to work for several weeks and was left with permanent scarring and some loss of sensation in his finger.

Personal Injury Claim

We acted on behalf of the injured man in a personal injury claim against his employer, as they failed to provide a safe method of work, did not ensure that the machinery was in working order and did not provide suitable equipment and training to minimise the risk of our client suffering an injury.

The defendants admitted liability for the accident. We submitted medical evidence and they made an offer of compensation, but the offer was too low in light of the extent of the injury our client sustained. We therefore negotiated for an increased offer and he received more than £8,500 in damages.
