Compensation Claim for Midwife Injured in Fall at Work

Accident at Work

During the delivery of a baby, the midwife needed to use a foetal monitor, which was electronic and had several wires extending from it.

The wires became entangled around her foot at some point and caused her to fall. She injured her hip in the accident and, although the claimant could not say exactly how she came to fall, she did not feel that adequate risk assessments had been made.

Employer Liability

The claimant appointed The Legal Line’s lawyers, Thompsons Solicitors, to act on her behalf. Her employers denied liability for what happened, however the claimant relied on the Workplace Regulations and the Provision and Use of Work Equipment Regulations (PUWER), in that the defendants had a duty to carry out risk assessments.

When the case commenced the Judge advised the Trust that, as the possibility of alternative equipment should have been investigated, there was a risk to them and they should consider offering a settlement. Despite this, they proceeded with their defence.

Compensation Awarded

The Judge found in favour of the claimant, stating that the defendants should have made risk assessments to ensure that no other, more suitable equipment could have been used in place of the foetal monitor in question.
