Wet Floor on Stairs Causes Serious Fall at Work

26th April 2011

In a recent personal injury claim, our lawyers recovered over £40,000 compensation for a court clerk, who suffered long term injuries to her knees, shoulder and back in an accident at work.

Slip on Wet Floor

Our client and a colleague were descending some stairs when her workplace accident occurred. She was carrying files in one hand, but was not overloaded and was holding the banister. As she reached a flat area between the two flights of stairs she slipped and fell, because the surface was covered with water.

She was assisted by her colleague and reported the incident to a manager. It came to light that the stairs were wet because they had recently been cleaned by the cleaning staff. This job should have been left until the end of the working day.

Multiple Injuries

Our client fell and landed heavily, suffering damage to both knees and soft tissue injuries to her back, shoulder and arm. It was necessary for her to have physiotherapy treatment and she required a lot of assistance from her family with day to day tasks for several months following the accident.

Unfortunately she was left with ongoing problems and still has pain, restricted movement and difficulty with lifting and walking longer distances. This affects her ability to work and perform certain activities, such as taking her child to school, and she may require further medical treatment in the future. There is also a risk with the type of injury she sustained that she may develop early-onset arthritis.

Personal Injury Claim

The injured employee instructed our expert personal injury lawyers to assist her in making a claim, as she felt her accident could have been avoided if adequate health and safety procedures were followed.

Initially the defendants denied liability for our client’s personal injury, however we continued to pursue the case against them and eventually they reconsidered and admitted responsibility. They were unwilling to put forward a suitable offer of damages however, so we commenced Court proceedings.

We put forward medical evidence and entered into negotiations with them and we were able to secure £40,000 for our client. This took into account the pain and suffering caused by her injuries and also her financial losses, including her loss of earnings, physiotherapy costs, travel expenses, prescription charges and the costs of care and assistance she required.
