Injury Claim for Pensioner Involved in Tripping Accident

A lady injured in a fall outside a social centre for the elderly appointed our solicitors to assist her in a personal injury claim and received compensation.

Personal Injury

Our client, who was 79 years old at the time of her accident, was walking along a paved area outside the social centre. One of the slabs was raised by up to an inch and this caused her to trip and fall.

The claimant painfully fractured both wrists and required hospital treatment including surgery to repair the damage. The injuries left her unable to perform many of her regular daily tasks and activities for some time after the accident.

Compensation Claim

Our expert personal injury lawyers were appointed to pursue a compensation claim on the claimant’s behalf. The local authority responsible for the premises denied liability for the accident and it was necessary to pursue the matter to court.

The Judge found that because the centre was mainly used by elderly persons it should be held to a higher standard of what was reasonably safe, as they would be more vulnerable to tripping hazards. It was therefore felt that a daily walking inspection would be appropriate, however the manager was on holiday at the time of the accident and no system had been put into place to cover these checks during her absence.

It was found that the local authority had not taken reasonable steps to ensure the safety of the claimant and she was awarded damages in respect of her injuries.
