Personal Injury Caused by Hole on Council Property

In an accident caused by a hole on a neighbour’s council-owned property, our client suffered a fractured toe. Our specialist lawyers pursued a personal injury claim on her behalf and recovered compensation.

Hazard on Path

Our client was visiting a neighbour when her accident occurred. Her young child was running down the path and she went after him, at which point her foot went into a hole and she fell. The hole was present because of a defective cover on a “Tobey Box”, which covered the water supply to the property. It had been problematic for some time and would often come off, so our client’s neighbour would have to try and put it back on herself.

Although council tradesmen had often attended the property to carry out work, they had not noted the defect and repaired it, or reported it to the council.

Claim Against Council

We acted on behalf of the injured woman and pursued an injury claim against the council, who initially denied that they were responsible for the accident.

The case was taken to court and the Judge accepted that the Tobey Box was dangerous and the workmen should have reported it. Our client received compensation in respect of her personal injury.
