Care Assistant Receives Compensation for Burn Injury

After a care assistant suffered a burn injury in an accident at work, our specialist personal injury lawyers assisted her in making a successful personal injury claim against her employer.

Injured at Work

In the course of her work at a residential home for elderly people, our client was taking some food out of a heated trolley. The plates had been stacked at the very back of the trolley and right up to the shelf above them, so she was unable to use the gauntlets provided as they were too awkward for the job and did not provide enough grip.

It was therefore a common practice for employees to use a tea towel to take out the plates. As our client did this however she suffered an arm injury in the form of a burn on her forearm.

Compensation Claim

Our client felt that her injury could have been avoided if her employer had ensured a safer system of work was in place. She had reported to her manager in the past that the gauntlets were unsuitable and the plates were, in any event, supposed to be placed on top of the trolley before mealtimes and not inside it due to the high temperature.

Her employer denied that they were responsible and we commenced court proceedings. The Judge found in favour of our client and she was awarded damages in respect of her injury.
