House of Lords Decision on Pleural Plaques Compensation

 

A disappointing decision by the House of Lords to end compensation for the asbestos related condition, pleural plaques, has now been announced.

Pleural Plaques

One of several conditions caused by exposure to asbestos, pleural plaques refers to areas of scarring on the lining of the lungs.

There are usually no symptoms associated with pleural plaques, however those affected are at an increased risk of developing other asbestos related diseases, including mesothelioma, an incurable form of lung cancer.

Right to Compensation

In previous years, it had been possible for people diagnosed with pleural plaques to claim compensation if they were exposed to asbestos due to the negligence of someone else, usually an employer.

The appeal was made against an earlier ruling by the Court of Appeal to stop compensation in January 2006.

As a result of the ruling, made following a four day hearing in June of this year, thousands of people living with the condition now and in the future will not be entitled to damages. The Judgment will mean huge savings for the insurance companies of employers who negligently exposed their employees to asbestos, risking their health.

Ian McFall, head of asbestos policy at Thompsons Solicitors, The Legal Line’s lawyers, commented: “This decision is very disappointing for the thousands of people who are living with the worry of knowing that their lungs have been scarred by asbestos.

“They will be baffled and offended that the House of Lords has decided that pleural plaques are not worthy of compensation.”
