Outbreak of Q Fever Caused by Unsafe Workplace Renovations

In a recent group action case our specialist personal injury lawyers acted for several employees of a factory, where an outbreak of Q fever occurred because of bacteria spores released into the air during renovations.

Exposure to Hazard at Work

Q fever is a relatively uncommon bacterial infection that can be transmitted to humans via livestock. It is therefore normally associated with farm workers and those in close contact with animals. Symptoms of the illness range from headaches, flu-like symptoms and respiratory problems to vomiting and diarrhoea, and in severe cases even pneumonia or damage to the heart.

In this case, renovations were carried out in the office block of a factory, which had straw board insulation in the walls and ceilings. When the insulation was ripped out, large amounts of dust and particles containing dormant bacteria spores were released into the air around the factory and these were inhaled by the employees. More than 90 people developed symptoms of Q fever.

The way in which the renovations were carried out was assessed and evidence was obtained from engineers and a microbiologist. Although it was agreed that the employer and contractors could not have known the spores were present in the straw board, it was accepted that they were aware dust would be released and it is well known that dust can carry various hazards.

The case settled just before trial and our claimants agreed damages in respect of their pain, suffering and financial losses related to their illness.
