Road Worker Injured by Driver Receives Personal Injury Compensation

Road Accident

Our client was standing on the back of a stationary wagon, loading some items. A car suddenly collided with the wagon, causing him to be thrown from his feet. He hit the floor of the wagon and some of the contents toppled onto him.

As a result of this road accident our client suffered injuries to his neck, back, arms and legs. He received initial medical attention at hospital and then underwent a course of physiotherapy to aid his recovery. He was unable to work in his normal capacity for around 3 months and incurred a loss of earnings and loss of overtime because of his injury.

Accident Claim

The driver of the car failed to avoid the stationary wagon in the road, despite the fact that it was clearly visible and had lights displayed. Our client felt that this was negligent and he appointed our specialist lawyers to pursue a personal injury claim on his behalf.

We contacted the driver’s insurance company with details of the accident and they admitted liability, so we began negotiations with them in respect of a suitable settlement of damages. Their first offer did not reflect the extent of our client’s personal injury and the problems it caused him, so we rejected it. We were subsequently able to secure an increased offer and he received £10,000 compensation. This sum took into account his injuries and the related financial losses and expenses, including lost earnings and prescription costs.
