Pothole in Workplace Car Park Causes Leg Injury

18th July 2011

An employee suffered a motorcycle accident because of a poorly maintained car park at his workplace and badly fractured his leg. We secured compensation on his behalf in a personal injury claim against his employer.

Scooter Accident

Our client was riding his scooter out of the car park at his place of work, when the wheels went into a large pothole in the surface. It was over a metre wide and several inches deep, so there was a forceful jolt and he was thrown from the scooter.

As a result of this accident at work, our client suffered a serious leg injury and had to undergo surgery to repair the damage. He suffered post surgery complications which led to further treatment and a long period of recovery.

He was left with permanent, unsightly scarring, and a long term disability which restricts his mobility.

Compensation Claim

The claimant felt that his personal injury could have been avoided, as the large, obvious hole in the car park was likely to cause an accident and it should have been filled in. He appointed our specialist personal injury lawyers to pursue a compensation claim on his behalf.

We began a claim against our client’s employer and they admitted responsibility for the accident. While the case was in progress, we were able to obtain interim payments to help with his immediate expenses until a final settlement could be agreed upon and we eventually recovered in excess of £30,000 in damages for our client. This took into account the pain and suffering caused by his injury and also his financial losses, including his loss of earnings and expenses incurred in relation to his treatment and rehabilitation.
