Serious Eye Injury Caused by Lack of PPE and Unsafe Equipment

Accident at Work

The claimant was working at a council property when his accident occurred. He went to reach for a brush and caught his eye on the handle of a nearby cement mixer. The handle is usually covered by a rubber grip, however it had worn away and was not covered over with anything, leaving a piece of sharp metal exposed.

As a result of this accident at work, our client’s cornea was ripped out, causing a loss of sight. He also developed glaucoma and the medication for this caused several bouts of kidney stones, for which he required hospital treatment.

Personal Injury Claim

Our client felt that his injury could have been avoided if the cement mixer was in a safe condition. Better personal protective equipment may also have prevented the injury, as the safety glasses he was provided with had no band to secure them and they slipped off as he was working.

He instructed our specialist lawyers to pursue a claim against his employer. Evidence provided by our medical expert agreed that if a proper risk assessment had been carried out and the relevant safety measures were taken, the claimant would most likely have escaped with a much lesser injury, such as a black eye.

A settlement of damages was agreed shortly before the case was due to go to trial.
