Slipping Accident at Work Caused by Leaking Tap

10th August 2009

An employee who suffered a back injury in a workplace accident was recently assisted by our specialist personal injury solicitors.

Workplace Accident

Our client worked for a train company and was required to attend the premises of a rail catering company, who were not her employers, at one of the stations in order to collect items to fill her refreshments trolley.

A tap in the room had been leaking. Someone had placed a bucket underneath it, however it had not been repaired. The bucket was full and overflowing and water had seeped across the floor to the area of the door into the room. There were also no warning signs displayed in the room, or the corridor outside, to highlight the hazard and as our client entered the room she slipped on the water.

Our client slipped and fell, suffering injuries to her knee and lower back. She required medical treatment and had to take a lot of time off from work because of her personal injury. She eventually changed to a different job role altogether to accommodate her ongoing back problems.

Injury Compensation Claim

The claimant felt that the owners of the premises where her accident occurred had caused the accident. Although they were not her employers her accident happened in the course of her work and their premises formed part of her workplace. They had failed to provide a safe workplace and well maintained work equipment and did not take steps to warn her about the dangerous floor.

Our lawyers made a personal injury claim on her behalf. The owners of the premises initially denied liability, so court proceedings were commenced. It was possible to negotiate a settlement before the case went to trial however and a total of £11,000 compensation was secured for the injured employee.
