£100,000 Compensation for Widow of Mesothelioma Victim

Mesothelioma is a deadly form of cancer, most commonly affecting the lungs, which is caused by exposure to asbestos. Our client was diagnosed with mesothelioma when he underwent some tests at hospital after developing breathing problems, a nagging cough and pain under his ribs.

Although he was an elderly man, he had previously been able to provide care for his wife and undertake housework, shopping and gardening, but he became increasingly dependent upon family members as his condition worsened.

Mesothelioma Compensation Claim

He worked for the same employer, a rail company, throughout his working life and held various roles during this time. He would clean asbestos from the engines and boilers of steam trains when he worked as an engine cleaner earlier in his career, then he became a fireman and eventually a driver. Asbestos was used extensively as lagging in the steam trains and our client was exposed to it on a daily basis as it would blow around the cabs when he was working.

The claimant instructed our lawyers, who have extensive experience in recovering damages for mesothelioma victims and their families, to assist him in making a personal injury claim against his former employer.

He sadly passed away before the claim could be concluded, as the defendant’s insurers refused to negotiate a settlement and we had to commence Court proceedings. The case was successful however and £100,000 compensation was awarded to his widow. This sum took into account the pain and suffering caused by her late husband’s illness, funeral expenses, a sum for bereavement damages, care costs and the loss of services he previously provided.
