Personal Injury Caused by Unsafe Working Environment

A school cook supervisor who was injured in an accident at work due to a poorly fitted light cover was awarded damages recently, with help from The Legal Line lawyers, Thompsons Solicitors.

Whilst stacking boxes onto an upper shelf in a store room, the lady accidentally struck the cover of a fluorescent light. As it was not securely clipped into place it fell onto her head and shoulder, causing a personal injury.

Employer at Fault

Although the client herself was held partly responsible for the incident through knocking the light, the judge found that her employer was in breach of their duty. As the dimensions of the room and shelving were such that it was likely the light cover would be knocked, they should have taken greater care to ensure that a more securely fitted and sturdy light fitting was in place.
