Successful Accident At Work Compensation Claim

A man who lost his finger whilst using a seated lawn mower to cut the grass at the school for which he was a groundsman has been successful in obtaining compensation.

Accident at Work

The accident at work happened whilst the claimant was cutting the grass of the school grounds. The blades of the mower became jammed and the client was forced to remove the blockage by hand in order to start the machine again. As the claimant was doing this the machine started up again with the blades coming into contact with the claimant's hands. As a result of this the man lost his little finger and part of his ring finger.

The client began proceedings for an accident at work personal injury compensation claim with The Legal Line’s Solicitors; relying mainly on the Provision and Use of Work Equipment Regulations to secure his compensation.

Regulation 11 of the Provision and Use of Work Equipment Regulations was particularly important in this case as it refers to machinery where “protection devices and jigs are not effective in preventing access and a significant residual risk of injury remains.”

In this instance the judge believed that the claimant's accident at work could have been prevented had the machine been constructed so as to prevent contact with the cutting point whilst the moving blade was in motion. The judge ruled in favour of the claimant and was awarded compensation with a 15% deduction for contributory negligence.
