Compensation for Driver Injured by Unsuitable Van Door at Work

A man who was injured in an accident at work recovered damages recently, after appointing our specialist personal injury lawyers to assist him in making a claim.

Injury at Work

Our client opened a van door whilst working and put it on its catch. The conditions were windy however and the door came away, injuring his finger.

Although the door was not faulty as such, it was unsuitable for use in strong winds and so was not sufficiently safe to be used in the circumstances.

Our lawyers assisted the injured man in making a compensation claim against his employer.

The Judge found that the defendants were responsible for the accident, as the claimant was a very experienced driver and there was no reason why he would not have secured the door correctly. Therefore they were liable under strict liability for providing equipment that was unsuitable.

The driver was therefore awarded compensation in respect of his personal injury.
