Man Working at Height Injured by Falling Pallet

29th February 2012

A man suffered injuries in a warehouse accident, when a pallet fell onto him and crushed him. Our expert personal injury lawyers acted on his behalf in a compensation claim against his employer.

Warehouse Accident

Our client was working at height, using a harness, to make safe a spilled pallet. Complaints had previously been made to management that this should be a 2 person job, but these safety concerns were not acted upon.

The pallet fell onto our client, crushing him against part of a crane in an awkward position. He was stuck this way for some time before he was eventually rescued and he sustained injuries to his neck, back, shoulders and legs. He was also left with psychological trauma and anxiety.

After his accident at work, our client had to take some time off to recover. When he returned he was not able to work at height for several months.

Personal Injury Claim

Our client felt that his employer could have done more to prevent the accident and his personal injury, by providing a safe system of work and a suitable number of staff for the task. Appropriately qualified rescuers should also have been called to the scene urgently to free him, but there were delays because of ineffective communication.

We represented the injured worker in a personal injury claim and his employer admitted liability. We put forward medical evidence of his injuries and losses but the other side failed to make any offer of compensation, so it was necessary for us to commence court proceedings. We were able to negotiate a settlement before the case went to trial however and our client received £4,000 in damages.
