Laser hair removal is a treatment used to reduce the growth of unwanted hair on the face or body. The results are more long term than traditional ‘home’ methods, such as shaving, tweezing or waxing. In most cases some regrowth will occur eventually, however the hair is likely to be weaker and finer.
If you are considering laser hair removal, you should look for a clinic/centre that is registered with the Healthcare Commission or ask your GP for a recommendation.
A laser directs an intense beam of light over the desired area, which passes through the skin and is absorbed by the pigment in the hair follicle, destroying the hair. Several treatments may be required to produce the required result.
As the laser is absorbed by pigment, laser hair removal is not always suitable for darker skins and is not effective on pale blond, silver or white hair. The best results are usually seen on patients with fair skin and dark hair. The use of hair removal lasers on darker complexions should be carried out with care.
Although some discomfort, redness and swelling of the skin can be expected following laser hair removal, occasionally preventable injuries occur as the result of negligence.
If laser hair removal treatment is not carried out correctly by a skilled technician or nurse, or the equipment used is faulty, patients can suffer injury as a result.
Burns, blistering and scarring are amongst the types of personal injury that can be caused, leaving patients in unnecessary pain or with permanent scars. If you have suffered such an injury, you may be entitled to make a personal injury claim.
The assistance of a specialist lawyer can be invaluable if you intend to claim compensation for injuries caused by laser hair removal negligence, as the process is often complicated. They can collate all of the relevant evidence and advise the best course of action.
In every case, medical evidence will be required. It is necessary to show that the person or organisation you are making a claim against owed you a duty of care, that they breached that duty of care (what is known in law as negligence), and that the resulting problem was a reasonably foreseeable consequence of that negligence.
There are two elements to a compensation award. The first is called general damages and is financial compensation for the pain and suffering you may have gone through and what is known as loss of amenity. This can include an award for your inability to do things that you used to be able to do before, eg, play sports, walk the dog, carry out housework etc. The award for loss of amenity can be for a short period after you sustain an injury or for ever if that is what the medical evidence supports.
The second element of a compensation award is for your losses and expenses and is known as special damages. It is important to keep receipts for any expenditure you have related to your injuries, so that these can be reclaimed. The aim is to put you back in a position financially as if the negligent treatment had never occurred.
